Terms of Service

1. Nature of Service

The Awareness Fund ("TAF"), operated by Pyonair, provides artificial intelligence-powered software tools for market analysis and signal generation. Our service is a software tool that provides data analysis, pattern recognition, and signal generation capabilities.

We are NOT:

• A registered investment adviser in any jurisdiction
• A broker-dealer or financial planner
• A fiduciary to any user
• Providing personalized investment advice

2. No Investment Advice

Nothing provided by The Awareness Fund — including but not limited to trading signals, company analysis, backtested results, sector allocations, risk scores, or any other output — constitutes investment advice, a recommendation to buy or sell any security, or a solicitation of any kind.

All outputs are generated by artificial intelligence algorithms processing publicly available data. These outputs are informational tools only and should never be the sole basis for any investment decision.

3. User Responsibility

By using The Awareness Fund software, you acknowledge and agree that:

• You are making your own independent investment decisions
• You are solely responsible for evaluating the merits and risks of any investment
• You should consult with a qualified financial advisor before making investment decisions
• You understand that all investments carry risk, including the possible loss of your entire investment
• You will not rely solely on TAF software outputs for any financial decision

4. No Guarantee of Performance

Past performance does not guarantee future results. Backtested results, walk-forward validation results, and any historical performance data are presented for informational purposes only. Actual trading results may differ materially from backtested or simulated results due to:

• Market conditions that differ from historical patterns
• Execution timing and slippage
• Changes in market structure or regulations
• Model degradation over time
• Unforeseen market events

5. Software Limitations

The AI models underlying The Awareness Fund:

• May produce inaccurate or misleading outputs
• Are trained on historical data that may not predict future conditions
• May experience technical failures, bugs, or downtime
• Are not infallible and should be treated as one input among many

6. Limitation of Liability

To the maximum extent permitted by law, The Awareness Fund, Pyonair, and their officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or reliance on the software or its outputs
• Any investment decisions you make
• Any financial losses you incur
• Any inaccuracies in data, signals, or analysis provided
• Any service interruptions or technical failures

7. Indemnification

You agree to indemnify and hold harmless The Awareness Fund, Pyonair, and their affiliates from any claims, damages, losses, or expenses arising from your use of the software or any investment decisions you make.

8. Intellectual Property

All software, algorithms, models, analysis methodologies, and content are the proprietary property of Pyonair. Users may not reverse-engineer, copy, distribute, or create derivative works based on The Awareness Fund software without express written permission.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

10. Changes to Terms

Pyonair reserves the right to modify these Terms at any time. Continued use of the software after changes constitutes acceptance of the revised Terms.
